Data Protection Disclaimer

​in relation to data processing and with the Regulation (EU)

2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data

Between:

The undersigned company UAB DONKIS established in Žarijų g. 4, LT-02300 Vilnius, registered at the Chamber of Commerce under registration number 302786291 represented by the director Saulius Mateika hereinafter referred to as “Client”

 

and

 

UAB MP Mobility, established in Malūnininkų g. 3A, LT-92264 Klaipėda, registered at the Chamber of Commerce under registration number 306347815, represented by the director Mr. A.P. Bakker hereinafter referred to as Data Processor

1. All personal data provided by the Client and data concerning the use of devices/documents will be treated and used by Data Processor and/or third companies only for the purposes related to the Agreement, such as toll rebates, orders and invoicing.

2. All the collected data will be forwarded to Data Processor and/or third company for the managing of toll payments, as described in art. 3. Furthermore, the collected data will be forwarded to private motorway companies for invoicing purpose (costs recovery) in case of the issuing of non-payment records. Cost recovery and toll rebates can be managed by third parties which are specifically designated by Data Processor.

 

3. The administration such as invoicing and/or payment reminder letters will be carried out by Data Processor. The administration related to the toll bill domiciliation on the Client’s bank account will be managed by Data Processor.

 

4. Unless otherwise stated in the above mentioned articles, all the Clients data collected and stored in the data base of Data Processor and/or third parties, specifically designated by Data Processor which is responsible for personal data processing in compliance with art. 29 Legislative Decree 196/2003, will not be divulgated.

 

5. The motorway networks boasts detection systems to track the transit for “marketing/statistical” purposes but also in case of missed toll payment, missing toll ticket, misuse of infrastructures at the toll gates, car plates are automatically recorded to engage civil, administrative and/or legal procedures whenever necessary as per art. 176 Legislative Decree 285-1992. Video will be used exclusively by the personnel in charge to follow the procedures of payment retrieval, and in case of illicit actions in order to decide on legal actions. Those data will be treated exclusively by authorized personnel of third companies responsible for statistical processing (number of vehicles on a specific route), especially appointed for the processing of personal data.

 

6. The Client has therefore the right to ask for the updating of his personal data under the modalities and circumstances specified by law. In case of withdrawal of the contract, the Client may ask the cancellation of all the provided data anytime, with the exception of those data which have to be stored for a specific period of time under the legislation in force.
